The Websites are not directed at children under 16 years of age. We do not knowingly collect, use, share or sell Personal Information from children under 16. Data Security

We use reasonable physical, technical and organizational measures to help secure Personal Information against unauthorized access or acquisition appropriate to the type of Personal Information processed. If a breach of your Personal Information occurs, we will notify you of the breach if required under applicable law.

Badger Meter is not responsible for the privacy policies or practices of any third parties or any third-party websites. This Privacy Statement does not apply to any third-party websites or to any Personal Information that you may provide to third parties. For example, the shareholder website linked through our Websites, YouTube, Google Maps, and myworkdayjobs.com are all third-party websites not controlled by Badger Meter and not governed by this Privacy Statement.

YOUR STATE PRIVACY RIGHTS

The terms in this section are only applicable to residents of California, Colorado, Connecticut, and Virginia.   

Under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act, (together, the “CCPA”), the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), and the Virginia Consumer Data Privacy Act (“VDCPA”), residents of those states have additional rights with regard to their Personal Information. We have provided a summary of those rights below. Exercising Your Rights

Who May Exercise Your Rights. You may make a request to exercise your California privacy rights. A parent or legal guardian may make a request on behalf of their child. If you are a California resident, a person that you authorize to act on your behalf may submit requests to exercise your rights under the CCPA on your behalf. If you choose to use an authorized agent, you must (a) provide signed, written permission that authorizes the agent to submit requests on your behalf and (b) verify your identity directly with us or (c) directly confirm with us that you granted permission to the authorized agent to submit the request on your behalf. For clarity, you are required to verify the identity of both you and the authorized agent.

We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

Verifiable Consumer Requests. To verify your request, you must provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. 

When we receive your request to exercise your rights: (a) we will acknowledge receipt of your request; (b) we will try to match the information you provide in making the request with information we already maintain about you; (c) if required to verify your identity, we may ask you to provide additional information, including personal information, or to log into your existing account with us; (d) we will consider various factors when determining how to verify your identity, such as the sensitivity and value of the data, the risk of harm, the likelihood of fraud, etc. 

We will only use Personal Information we collect during the verification process for the purpose of verifying your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

When We Will Respond. We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and extension period. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. For data portability requests, we will select a format to provide your personal information to you. We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded.

EEA, UK & SWISS PRIVACY RIGHTS

The terms in this section are only applicable to those located in the European Economic Area (“EEA”), Switzerland, and the United Kingdom (“UK”).

The purpose of this Section is to provide information and additional provisions that apply to Badger Meter’s processing of Personal Data in accordance with the EU General Data Protection Regulation 2016/679 and the UK General Data Protection Regulation and the  Swiss Federal Data Protection Act (collectively referred to herein as the “GDPR”).  In the event of a conflict between this section and the remainder of the Privacy Statement, this section shall control for those persons located in the EU, Switzerland, or the UK.

Data Privacy Framework.

Badger Meter complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce.  Badger Meter has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of Personal Data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.  Badger Meter has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of Personal Data received from Switzerland in reliance on the Swiss-U.S. DPF. Badger Meter remains responsible for any of your Personal Information that is shared under the Onward Transfer Principle with third parties for external processing on our behalf, as described in the “Disclosing Personal Information” section of this Privacy Statement.

Lodging a Complaint

The U.S. Federal Trade Commission has jurisdiction over Badger Meter’s compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

An individual may, under certain conditions, invoke binding arbitration. Please see ANNEX I for more information on conditions giving rise to binding arbitration.

CANADIAN PRIVACY RIGHTS

The terms in this section are only applicable to residents of Canada.

Personal Information” means information about an identified or identifiable individual where such information can be linked to an individual either alone or in combination with other information (such as information contained in cookies).

Legal Disclosures and Lawful Requests. We, our service providers and affiliates may disclose your Personal Information (a) in response to a search warrant or other legally valid inquiry or order, (b) to another organization for the purposes of investigating a breach of an agreement or contravention of law, (c) for detecting, suppressing or preventing fraud, or (d) as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process.  This may include lawful access by U.S. or foreign courts, law enforcement or other government authorities. Your Rights and Choices

  • Right to Rectification - Under certain circumstances, you have the right to request that we amend or update inaccurate or incomplete Personal Information about you.
  • Right to Erasure (Deletion) - Under certain circumstances, you have the right to request deletion of your Personal Information.
  • Right to Restrict - Under certain circumstances, you have the right to request that we temporarily or permanently stop processing all or some of your Personal Information.
  • Right to Object - Under certain circumstances, you have the right to object to Badger Meter's Processing of your Personal Information (including profiling) when it is based on our legitimate interests.
  • Right to Data Portability - When we are processing your Personal Information based on consent or on a contract and the processing is carried out by automated means, you have the right to request a copy of your Personal Information in an electronic format and further request that we send such Personal Information to another party.

  • Right to Lodge a Complaint - You have the right to lodge a complaint with the applicable supervisory authority.

To exercise your rights described in this Privacy Statement, you may submit your request to us by contacting us using the information in the “Contact Us” section below.

In order to verify your request, you must provide sufficient information to allow us to reasonably verify you are the person about whom we collected personal information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. When we receive your request to exercise your rights under applicable law: (a) we will acknowledge receipt of your request; (b) we will try to match the information you provide in making the request with information we already maintain about you; (c) if required to verify your identity, we may ask you to provide additional information, including personal information; (d) we will consider various factors when determining how to verify your identity, such as the sensitivity and value of the data, the risk of harm, the likelihood of fraud, etc. 

We will only use personal information we collect during the verification process for the purpose of verifying your identity and fulfilling your request.  If you maintain an account with us, we may use that account to respond to your request and/or verify your identity.  If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

We will respond to your requests within the time period prescribed by applicable law. If we require additional time, we will inform you of the reason and extension period. 

MEXICAN PRIVACY RIGHTS

The terms in this section are only applicable to residents of Mexico.   In compliance with the Federal Law on Protection of Personal Data Held by Individuals (“LFPD”), we provide the following additional information regarding our privacy practices and your privacy rights.

You have the additional rights (i) to cancel your Personal Data when you deem it is not required for the purposes established in this Privacy Statement or that it is being used for unauthorized purposes, (ii) to oppose the processing of your Personal Data for certain specific purposes, and (iii) to file a complaint with the Federal Public Information Access Institute at www.ifai.org.mx. 

You may exercise rights (i) and (ii) through a written petition to us at the address below, accompanied by your email address and telephone number, and if applicable, specific details of the reasons for which a rectification, opposition or revocation of consent is requested.  We will respond to your petition within a reasonable amount of time and inform you of its outcome through the phone number and/or email address provided by you.
