SOURCE 1: We Collect Personal Information Directly From You

We collect Personal Information when you provide it to us, such as when you call or email us. Personal Information is required to use certain Website features, for example, to contact us via email or an online form (where we may retain your message’s content and our response) and to receive or request data from us (e.g., quotes, catalogs and newsletters).

Online Forms. We collect Personal Information from you when you fill out online forms on our Website with your contact information and inquiry, such as when you order publications, request materials or quotes from us, or request technical support.

Email Notifications. We collect your email address when you sign-up to receive email notifications on our Website. We may use your email address to send you promotional and other electronic and hardcopy communications. We may use third parties and/or service providers to deliver communications to you. You may opt-out of marketing emails by using the unsubscribe link in the email or contacting us at legal@badgermeter.com with “Unsubscribe” in the subject line. To opt out of other marketing communications (e.g., postal marketing and telemarketing), please contact us as set forth below. Opting out of marketing communications does not opt you out of communications about your account or transactions.

Feedback. When you provide comments or feedback about our Website, the Services, or our products or services ("Feedback"), we will not treat that Feedback as confidential and we may use that Feedback for any purpose in our sole discretion so long as it does not personally identify you. Feedback will be used without attribution or compensation to you. When you send us feedback through our Website, we may use a third party or service provider to gather that information.

Employment Applications. When you apply to work for Badger Meter via the Website, you will be re-directed to our service provider, Workday, Inc. ("Workday"). Workday will provide us with the information necessary for us to consider your application. Any information that you provide directly to Workday is governed by Workday's privacy policy, not this Privacy Policy.

Trade Shows. We collect Personal Information that you provide directly to us at trade shows and other similar events. We use that information for the purposes in which you provided it to us and to improve our marketing and networking efforts. We may use tools and applications provided by third parties and/or services providers to collect that information from you. If the trade show venue provides us the tools to collect your Personal Information, you should look to that trade show's privacy policy to learn how that trade show venue and their vendors use your Personal Information.

Paying Invoices Online. When you pay your invoices online, you will be re-directed to our PCI-compliant payment processor (“Payment Processor”). Any information that you provide directly to our Payment Processor is governed by that Payment Processor's privacy policy, not Badger Meter’s Privacy Policy. Badger Meter does not receive your credit card, debit card or other financial information when you pay through our Payment Processor, which is provided directly to the Payment Processor. However, Badger Meter does receive the customer number, payment amount, and invoice number. Badger Meter will keep a record of your invoices, and payments received or outstanding.

Badger Meter reserves the right to reject any other method of processing payments other than as provided in the previous paragraph. However, if Badger Meter agrees to process your payment using another method, Badger Meter will only use the payment information you provide to process your payments.

Training. When you register for training through the Website, you are directed to a third-party website to register and take the applicable training. The terms on that third-party website govern their collection, use and sharing of your Personal Information, not this Privacy Policy. We receive certain information pertaining to your registration for the training, which we use as described in this Privacy Policy.

Badger Meter Partner Central Community. When you click into Partner Central, you will be re-directed to our service provider, Salesforce, Inc. ("Salesforce"). Any information that you provide directly to Salesforce is governed by Salesforce's privacy policy, not this Privacy Policy.

SOURCE 2: We Collect Personal Information Automatically

Automatically Collected Data. We may collect certain types of information and data automatically, some of which is considered Personal Information depending on your place of residence or where you are located. For example, we collect system type, access times, external links you clicked to reach our Website, pages you visit while viewing our Website, data collected by the servers used to operate the Services, data collected by cookies, and data collected by analytics and advertising services. What is Collected and Why? We use cookies and other tracking technologies to learn whether the Website is operating optimally, to learn whether you are a repeat visitor to our Website, for personalized advertising, to provide us with valuable data and statistics about the usage and effectiveness of our Website, and to enable us to provide an enjoyable, personalized and innovative online experience for you. How Long do Cookies Last? The Website uses session cookies and persistent cookies:

DO NOT TRACK. SOME BROWSERS HAVE A “DO NOT TRACK” FEATURE THAT ALLOWS YOU TO TELL A WEBSITE THAT YOU DO NOT WANT TO HAVE YOUR ONLINE ACTIVITIES TRACKED. OUR WEBSITE IS CONFIGURED TO HONOR “DO NOT TRACK” REQUESTS.

Pixel Tags. Certain pages on our Website contain “pixel tags” also known as internet tags, web beacons and clear GIFs. A pixel tag is a small graphic image placed on the web page designed to allow us to monitor and obtain information about our Website traffic, such as the IP address of the computer that downloaded the page on which the tag appears, the URL of the page, the time the page was viewed, the type of browser used to view the page, and the information in cookies set by vendors we use to assist us with advertising to you. We also use pixel tags to recognize a unique cookie on your web browser, which enables us to learn which advertisements brought you to our Website.

We may implement additional add-on services to Google Analytics, such as Demographics and Interest Reporting. Demographics and Interest Reporting uses Cookies to collect data about our Website traffic by tracking users across websites and across time to provide us with analytics on our user base.

Interest Based Advertising. Badger Meter uses vendors to help it provide online behavioral advertising (also called "targeted advertising" or "interest based advertising") which is the practice of tracking an individual's online activities over time, including searches the person conducts, webpages visited and content viewed in order to deliver targeted advertising based on the person's interests. The data collected may contain, or be associated with, your Personal Information. These advertisements may appear on the Website and on other websites, or may be sent to you via email.

Most third-party advertising networks permit you to opt-out of targeted advertising by clicking on the displayed icon within the advertisements. Your opt-out choices may be affected by your use of a specific device, your browser settings or your log-on credentials. Please refer to the website that you are visiting, your browser settings and/or your device settings for additional information. Opting-out will not prevent you from receiving advertisements completely, only targeted advertisements based on your online behavior.

Further, an opt-out only applies to the web browser from which you opted out, so you must opt-out of each web browser on each device that you use. Badger Meter may implement additional ad-on services to Google Analytics, such as:

  • Demographics and Interest Reporting, which gathers information such as the age and gender of users from other websites, along with certain interests those users express through their purchasing activities and other online activities, by tracking users across websites and across time.
  • Remarketing with Google Analytics, which uses user behaviors on our Site to help us identify users for our remarketing campaigns.

Video. The Website contains videos and embedded content provided by Badger Meter and its vendors, including visible content and/or feeds scripts embedded in the Website's code. SOURCE 3: We Collect Personal Information From Third-Party Sources.

We obtain data about individuals from various third-party companies and public sources and we may combine that data with Personal Information we already have.

De-Identified / Aggregated Data

We may aggregate or de-identify Personal Information and other information to create anonymous, aggregate data about users of the Services, which describes users as a group but does not reveal the identity of individual users. Any information or data that has been de-identified and/or aggregated so that it no longer contains Personal Information will not be treated as Personal Information (for example, we may aggregate Personal Information to calculate the percentage of users in a particular zip code).

Badger Meter is the sole and exclusive owner of any information or data that it collects or creates which does not identify a natural person (including Personal Information that has been de-identified and/or aggregated). Badger Meter may use or share such de-identified or aggregated data for any business purpose as determined in its sole discretion, in compliance with applicable laws.

Purpose for Collecting Personal Information

We may use all categories of Personal Information listed above for the following business purposes:

As Stated or Agreed to at the Point of Collection. We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we use Personal Information to respond to your questions, comments, or complaints. We may also use Personal Information as requested or consented to by you.

Administration. We use Personal Information for administrative purposes, such as managing your accounts, facilitating transactions, to inform our business strategies, to understand the Website’s demographics and user preferences, for evaluating applications, and managing profiles.

Those other providers may also provide Badger Meter with a variety of services, including without limitation, data collection and analysis, reporting, ad response measurement, delivery of marketing messages, public relations, analytical information, market research surveys, to help us improve the content, security and functionality of the Website, technical support, data processing, and other Website management. Professional Advisors. We may share Personal Information with professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to Badger Meter.

Other Users. By submitting a copyright infringement notice, counter-notice or other similar notification, you consent to having that communication forwarded to any person or entity to whom the notice or counter-notice relates to, in order to facilitate a prompt resolution of the copyright infringement claim. Change in Ownership. In the event Badger Meter is the subject of a change of control or in the event the Website changes ownership, in whole or in part, or in the event of a bankruptcy, receivership or a similar transaction, we may provide Personal Information to the subsequent owner(s).

For clarity, and without limiting the foregoing, we do not sell the Personal Information of anyone under the age of 16 years old without affirmative authorization.

When we receive your request to exercise your rights described in this Policy: (a) we will acknowledge receipt of your request; (b) we will try to match the information you provide in making the request with information we already maintain about you; (c) if required to verify your identity, we may ask you to provide additional information, including personal information; (d) we will consider various factors when determining how to verify your identity, such as the sensitivity and value of the data, the risk of harm, the likelihood of fraud, etc.

We will only use personal information we collect during the verification process for the purpose of verifying your identity. If you maintain an account with us, we may use that account to respond to your request and/or verify your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

When We Will Respond. We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and extension period. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. For data portability requests, we will select a format to provide your Personal Information to you. We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded.

Non-Discrimination.

You have a right to not receive discriminatory treatment for exercising any of your rights under the CCPA.

Who May Exercise Your Rights?

You may only make a request to exercise your rights on behalf of yourself. If you are a California resident, you also have a right to submit requests to exercise your rights through an authorized agent. An authorized agent must be registered with the Secretary of State in California to conduct business in California. If you choose to use an authorized agent, you must (a) provide signed permission to that authorized agent to submit requests on your behalf, (b) verify your identity directly with Company, and (c) directly confirm with Company that you granted permission to the authorized agent to submit the request on your behalf. For clarity, you are required to verify the identity of both yourself and the authorized agent.

We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

Furthermore, a parent or legal guardian may make a request on behalf of their child.
